These Terms and Conditions (“Terms”) apply to your use of asmpromotions.com (the “Site”), our text messaging program, and the music promotion services offered by A Social Movement Promotions (“A.S.M. Promotions,” “we,” “us,” or “our”). By using the Site, booking a service, or opting in to text messages, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Text messaging (SMS) terms
Program name: A.S.M. Promotions Artist Updates.
Program description: When you opt in, A.S.M. Promotions will send text messages to the mobile number you provide about your inquiry, booking, and campaign. This includes replies to your questions, booking confirmations, appointment reminders, requests for your song or content, campaign status updates, and payment reminders. We will not send you marketing or promotional texts under this program unless you separately opt in to receive them.
How to opt in: Text JOIN to (912) 717-9800. You will receive a confirmation text, and you can reply STOP at any time. Opting in is voluntary and is not a condition of buying any service.
Message frequency: Message frequency varies based on your booking and campaign activity.
Message and data rates may apply. Check your mobile plan for details.
Opt out: Reply STOP to any message to stop receiving texts. You can also reply END, CANCEL, UNSUBSCRIBE, or QUIT. We will send one final message confirming that you have been unsubscribed, and you will not receive more texts from this program unless you opt in again.

Carriers are not liable for any delayed or undelivered messages.
Eligibility: You must be the account holder or authorized user of the mobile number you provide. If you change or give up your number, please reply STOP from that number or let us know.
Privacy: We do not sell, rent, or share your mobile number or text message opt-in consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.
2. Our services
We provide music marketing services for independent artists, including Meta (Facebook and Instagram) ad campaigns, content creation, street team promotion in the Atlanta area, playlist and blog pitching, and related services described on the Site. Package descriptions, prices, and delivery times on the Site are summaries. The specific scope, timeline, and terms of your project will be confirmed in your proposal and service agreement, which you will receive through HoneyBook. If your signed service agreement conflicts with these Terms, the service agreement controls for that project.
Delivery times start once we have received payment and everything we need from you, such as your song, artwork, video clips, and account access.
3. No guaranteed results
We run real campaigns and report results honestly, but we do not guarantee any specific number of streams, followers, views, sales, playlist placements, or other outcomes. Results depend on your music, your content, your ad budget, platform algorithms, and other factors outside our control. We never use bots, fake streams, or fake engagement.
4. Payments and ad spend
Prices on the Site are our service fees in U.S. dollars. Quick-turn services, starter packages, and event promotion are paid upfront. The Single Launch package can be paid in full or split into two payments. Monthly plans are billed monthly, have a 3-month minimum, and can be cancelled with 30 days’ written notice after the minimum term. Payments are processed securely through HoneyBook and its payment processors.
Ad spend is not included in our fees. Ad spend is paid directly to Meta or the relevant platform, usually on your own card. Each package lists a minimum recommended ad spend.
Refunds are covered by our Refund Policy.
5. Platform rules
Ads must follow the rules of Meta and any other platform we use. Platforms may reject or limit ads with explicit lyrics, imagery, or other content. We will suggest edits when we can, but approval decisions are made by the platform, not by us.
6. Your music and content
You confirm that you own or have the rights to the music, artwork, videos, names, and other materials you give us, and that our use of them for your campaign will not infringe anyone else’s rights. You keep ownership of your music and materials. You give us a limited, non-exclusive license to use, edit, and publish them only to provide your services. We may show campaign examples in our portfolio or social media only with your permission.
7. Minors
If you are under 18, a parent or legal guardian must agree to these Terms and sign your service agreement on your behalf.
8. Street promotion
Street team services are available in the Atlanta area only. We place promotional materials in public or permitted locations and follow applicable local rules. We are not responsible for materials that are removed, damaged, or covered by others after placement.
9. Use of the Site
You agree not to misuse the Site, including by trying to access it without authorization, interfering with its operation, or using it for unlawful purposes. The Site’s design, text, logo, and graphics belong to A.S.M. Promotions and may not be copied without permission. The Site may link to third-party services such as HoneyBook and Instagram, and those services have their own terms and privacy policies.
10. Disclaimers and limits of liability
The Site and our services are provided “as is” to the fullest extent allowed by law. To the fullest extent allowed by law, A.S.M. Promotions will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or lost opportunities. Our total liability for any claim related to a service will not exceed the amount you paid us for that service.
11. Indemnity
You agree to cover any claims, losses, or costs, including reasonable attorney’s fees, that come from content you provided to us or from your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Fulton County, Georgia, unless your service agreement says otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Changes do not affect a service agreement you have already signed.
